Who Can Apply for Italian Citizenship by Marriage
1. Residency Requirement in Italy or Abroad
If the couple is resident in Italy: the foreign spouse/civil partner may apply after two years from the date of marriage.
If the couple is resident abroad: the foreign spouse/civil partner may apply after three years from the date of marriage.
These timeframes are halved in the presence of children.
Please note: if the spouse/civil partner is a naturalized Italian citizen, the above timeframes run from the date of the oath. The Italian spouse/civil partner must be registered with AIRE, and the marriage/civil union must be registered in Italy. This is done through the competent Italian Consulate for the place of residence.
2. Marital Status – Duration Requirement of the Marriage/Civil Union
The marriage/civil union must be valid and ongoing throughout the entire procedure, from the submission of the application until the final issuance of the citizenship decree. Any separation (legal or de facto), termination of the marriage, dissolution of the marriage (or union), or divorce during this period may result in the rejection of the application.
The death of the spouse/civil partner after the submission of the citizenship application does not result in the loss of eligibility.
3. Knowledge of the Italian Language – B1 Citizenship Exam
A certification of Italian language proficiency at B1 level or higher of the Common European Framework is required. This requirement, introduced by Decree Law 113/2018 (Security Decree), does not apply to:
- Holders of an EU long-term residence permit
- Those who have signed the Integration Agreement pursuant to Art. 4bis of Legislative Decree 286/1998
Unlike citizenship by residency applications, applicants for citizenship by marriage are not required to demonstrate financial self-sufficiency.
Another key difference lies in the assessment of the applicant’s legal conduct.
For citizenship by residency, authorities generally reject applications in the presence of criminal records, regardless of the outcome of the proceedings. This approach aims to ensure proper social integration.
In the case of applications based on marriage/civil union, rehabilitation removes the negative effects of previous convictions, often leading to the almost automatic granting of citizenship.
Documents Required for the Italian Citizenship by Marriage Application
To apply for Italian citizenship by marriage, the following documents are required:
1. Certificate of marriage or civil partnership.
2. Certificate of birth of the applicant.
3.Self-certification historical residence and family status.
4. Front and back copy of the identity document.
5. Codice fiscale, if applicable.
6. Criminal record certificate from your country of residence and from any other country where you have lived.
7. Payment of €250 and a €16 revenue stamp.
8. Certificate proving knowledge of the Italian language at B1 level, where required.
All non-Italian documents must meet specific requirements:
- If your country is a signatory to the Hague Convention, the documents must be apostilled and translated into Italian.
- If your country is not a signatory to the Hague Convention, the documents must be legalized through the Italian Embassy or Consulate and translated into Italian.
- If you are an EU citizen, for example a German married to an Italian, the apostille is not required, but only the sworn translation.
